Real Estate Law FAQs Kenya
Answers to Kenyan property questions: choosing a lawyer, title searches, sale agreements, diaspora buying, sectional titles, leases and disputes.
These answers explain common starting points. The advice for your property depends on the documents, legal framework and circumstances.
How do I choose a property lawyer?
Compare relevant work, independence, written scope, responsible advocate, reporting and fee terms. A ranking alone does not establish suitability for a particular transaction.
Is a title search enough before buying?
It is useful registry information, but broader due diligence may examine authority, supporting records, occupation, access, survey and planning questions.
Can WKA Advocates review a sale agreement?
The firm can assess your draft and proposed transaction under agreed instructions, including payment, conditions, completion and default provisions.
Can I buy Kenyan property while living abroad?
Remote instructions can be considered with appropriate identity checks, signing, reporting and payment arrangements. Citizenship and ownership eligibility are separate questions.
Can non-citizens own freehold land?
Article 65 of the Constitution limits non-citizen landholding to leasehold tenure for a term not exceeding 99 years. The buyer and proposed structure need legal review.
What should I check when buying an apartment?
Review unit ownership, sectional arrangements where applicable, management, shared property, service charges and completion documents.
Will the seller's lawyer protect my interests?
The advocate's role and instructions must be clear. Discuss independent representation and any potential conflict before relying on advice in the transaction.
How long does a property transfer take?
Timing depends on documents, consents, financing, registry processes and the particular property. Obtain a transaction-specific estimate rather than a guarantee.
Does ownership allow any development?
No. Planning, permitted use and other applicable approvals must be investigated against the intended project.
What documents should I bring for a dispute?
Prepare title and acquisition records, agreements, notices, correspondence and a dated account of events, including current occupation and urgent risks.
